PRIVACY POLICY
PRIVACY POLICY PURSUANT TO ART. 13 OF EU REGULATION 2016/679 with regard to the data processed through this site
We would like to inform you about the ways in which the data are processed and the rights you can exercise under current data protection legislation, in particular EU Regulation 2016/679 (hereinafter also: "GDPR").
1. Data Controller

3. Purposes and legal bases for the processing of personal data
3.1 Purposes covered by the data subject's consent (pursuant to Art. 6, paragraph 1 (a) GDPR)
The personal data provided by the user through the form are collected and processed for the following purposes:
a. to carry out customer relations activities on the basis of contractual agreements (e.g. expression of interest, purchase contract, etc.)
b. for administrative purposes and for the fulfilment of legal obligations such as those of an accounting or tax nature, or to process requests from the judicial authorities;
c. in the presence of specific consent, for the periodic sending, by e-mail, of newsletters and advertising material, updates on our activities and reports on the publication of posts from our blog
For the purpose: a, until the request is processed, unless the feedback provided and the information exchanged are necessary to demonstrate the fulfilment of any contractual obligations or obligations deriving from any legal relationships established (in this case, the retention period will be equal to that indicated in the appropriate information notices, issued as part of the aforementioned relationships). The legal basis that legitimizes the processing is the execution of a contract to which the data subject is a party or the execution of pre-contractual measures adopted at the request of the same. In the cases expressly indicated, the legal basis is the consent freely provided by the data subject.
3. 2 Nature of the provision
The provision of data: - with respect to the purposes referred to in letters a) and b) is optional but any refusal will make it impossible to implement the contractual commitments undertaken.
- with respect to the purposes referred to in letter c) it is also optional: use is subject to the issuance of explicit consent. Any refusal will make it impossible for VIOLINETTA to send newsletters and advertising material or invitations to events and initiatives.
4. Recipients or categories of recipients of personal data (pursuant to Art. 13 para. 1 (e) GDPR)
As part of the aforementioned purposes, the Data Controller may communicate your data to:
• Offices and internal functions of the Data Controller itself;
• Companies and professional operators that provide IT services, including electronic data processing, software management, site management and IT consultancy, including mailing companies and hosting providers;
• Consultants, professionals and service companies for business administration and management that operate on behalf of the Data Controller;
• Public Administrations, public bodies and agencies within the scope of their institutional tasks.
In any case, personal data will never be disseminated.
5. Recipients or categories of recipients of personal data (pursuant to Article 13 paragraph 1 (f) of the GDPR) and transfer of data to non-EU countries
The Data Controller informs you that it has no intention of transferring your data to countries outside the EU and EEA for the purposes indicated above.
6. Rights of the data subject
The data subject, in relation to the personal data covered by this policy, has the right to exercise the rights provided for by the EU Regulation set out below:
• Right of access of the data subject [art. 15 of the EU Regulation] (consisting of the possibility of being informed about the processing carried out on their personal data and possibly receiving a copy thereof);
• Right to rectification of their personal data [art. 16 of the EU Regulation] (the data subject has the right to rectification of inaccurate personal data concerning him/her);
• Right to erasure of their personal data without undue delay ("right to be forgotten") [art. 17 of the EU Regulation] (the data subject has, and will have, the right to erasure of their data);
• Right to restriction of processing of your personal data in the cases provided for by art. 18 of the EU Regulation, including in the case of unlawful processing or contestation of the accuracy of personal data by the data subject [art. 18 of the EU Regulation];
• Right to data portability [art. 20 of the EU Regulation], (the data subject may request his/her personal data in a structured format in order to transmit them to another Data Controller, in the cases provided for by the same article);
• Right to object to the processing of their personal data [art. 21 of the EU Regulation] (the data subject has, and will have, the right to object to the processing of their personal data in the cases provided for and regulated by art. 21 of the EU Regulation);
• Right not to be subject to automated decision-making processes [art. 22 of the EU Regulation] (the data subject has, and will have, the right not to be subject to a decision based solely on automated processing).
With regard to the purposes for which consent is required, the Data Subject may withdraw his/her consent at any time and the effects will start from the moment of revocation, without prejudice to the terms provided for by law. In general terms, the withdrawal of consent only takes effect for the future. The aforementioned rights can be exercised in accordance with the provisions of the EU Regulation by sending an e-mail to info@violinetta.it.
Violinetta Srls, in compliance with art. 19 of the EU Regulation, proceeds to inform the recipients to whom the personal data have been communicated, of any rectifications, cancellations or limitations of processing requested, where possible.
In order to allow a more rapid response to your requests made in the exercise of the aforementioned rights, they may be addressed to the Data Controller by addressing them to the addresses indicated in point 1.
7. Right to lodge a complaint (pursuant to Art. 13 para. 2 (d) GDPR)
If the data subject believes that his or her rights have been compromised, he or she has the right to lodge a complaint with the Data Protection Authority.
For further information on the rights and the exercise of the same, please refer to http://www.garanteprivacy.it/web/guest/home/docweb/-/docweb-display/docweb/4535524 or by sending written communication to the Guarantor Authority for the Protection of Personal Data.
8. Possible consequence of failure to provide data and nature of the provision of data (pursuant to Article 13 paragraph 2 (e) of the GDPR)
8.1 In case of consent of the data subject
We inform you that the purposes set out above have consent as their legal basis and that, with regard to these purposes, the Data Subject may revoke his/her consent at any time and the effects will start from the moment of revocation, without prejudice to the terms provided for by law. In general terms, the withdrawal of consent only takes effect for the future. Therefore, the processing that was carried out before the withdrawal of consent will not be affected and will retain its legitimacy.
The lack of or partial consent (or the withdrawal of the same) may not guarantee the complete provision of the services or activities, with reference to the individual purposes for which consent is denied, and will not constitute prejudice or impediment to the other purposes (and the activities connected to them) not involved or expressly affected by the denial of consent or not based on this legal basis.
It should be noted that with reference to the request for information, while consent to the processing of personal data remains free and optional, it is necessary for the processing of the request. Therefore, the sending of the request or equivalent expression of will be considered as the release of consent, which will always be revocable with the consequences illustrated above.
When the data are no longer needed, they are regularly deleted, if their deletion is impossible or possible only in the face of a disproportionate effort due to a particular storage method, the data cannot be processed and must be archived in inaccessible areas.
9. Existence of automated decision-making (including profiling)
The use of purely automated decision-making processes as detailed in Article 22 of the GDPR is currently excluded. If it is decided in the future to establish such processes for individual cases, you will be notified separately if required to do so by law or update this policy.
10. Processing methods
Personal data will be processed in computerized and telematic form and entered in the relevant databases which may be accessed, and therefore become aware, by the employees expressly designated by the Data Controller as Data Processors and Authorized for the processing of personal data, who may carry out consultation, use, processing, comparison and any other appropriate operation, including automated ones, in compliance with the provisions of the law necessary to ensure, among other things, the confidentiality and security of the data as well as the accuracy, up-to-date and relevance of the data with respect to the stated purposes.
